Welcome to GayRoomies.net (“GayRoomies,” “we,” “us,” or “our”). GayRoomies.net is an online community and housing marketplace designed to help LGBTQ+ individuals, gay-friendly landlords, tenants, roommates, and housing seekers connect.

By accessing or using GayRoomies.net, creating an account, posting a listing, contacting another member, subscribing to a membership, or otherwise using our services, you agree to be bound by these Terms & Conditions (“Terms”).

If you do not agree to these Terms, please do not use GayRoomies.net.

1. About GayRoomies.net

GayRoomies.net provides an online platform where users may:

  • Create personal profiles.
  • Search for housing, roommates, tenants, or housing opportunities.
  • Create rental, housing, roommate, sale, or “In Search Of” listings where available.
  • Communicate with other users.
  • Participate in roommate and housing matching services.
  • Purchase or subscribe to optional membership features.
  • Share information about housing preferences and availability.

GayRoomies.net is a platform and community service. We are not a landlord, property manager, real estate broker, real estate agent, tenant, roommate, or housing provider unless explicitly stated otherwise.

GayRoomies.net does not own, lease, manage, inspect, maintain, or guarantee any property advertised through the platform.

2. Eligibility

You must be legally capable of entering into a binding agreement to use GayRoomies.net.

By using the website, you represent that:

  • The information you provide is accurate and current.
  • You are not prohibited from using the service under applicable law.
  • You will comply with all applicable federal, state, and local laws.
  • You will use the platform only for lawful purposes.
  • You will not create an account using false or misleading information.

If we determine that an account does not meet our eligibility requirements, we may suspend or terminate the account.

3. User Accounts

Certain features require you to create an account.

You are responsible for:

  • Providing accurate registration information.
  • Keeping your password and login credentials confidential.
  • Maintaining the security of your account.
  • Updating your information when it changes.
  • All activity conducted through your account.

You agree to notify GayRoomies.net promptly if you believe your account has been compromised or accessed without authorization.

4. User Profiles

You are responsible for the information contained in your profile.

You agree not to impersonate another person, organization, landlord, tenant, or business.

GayRoomies.net may remove or restrict profiles that contain false, misleading, offensive, unlawful, fraudulent, or otherwise inappropriate information.

5. Housing and Property Listings

Users may create housing-related listings where those features are available.

Listings must contain accurate information, including, where applicable:

  • Property location.
  • Rent or sale price.
  • Availability.
  • Deposit requirements.
  • Property features.
  • Room or property description.
  • Lease requirements.
  • Contact information.
  • Photographs.

You must have the legal right or authorization to advertise a property.

You may not advertise a property that you do not own, manage, represent, or have authorization to offer.

GayRoomies.net reserves the right to remove listings that appear fraudulent, misleading, inaccurate, unlawful, duplicated, expired, or otherwise inconsistent with these Terms.

6. “In Search Of” Listings

Users may post “In Search Of” listings describing the type of housing, roommate, or living arrangement they are seeking.

Users must provide truthful information and must not use these listings to solicit illegal activities, prohibited services, or unrelated commercial activity.

7. User-to-User Transactions and Agreements

Any rental agreement, roommate agreement, lease, sale, deposit, payment, move-in arrangement, or other transaction entered into between users is solely between those users.

GayRoomies.net is not a party to those agreements unless expressly stated otherwise.

You are responsible for conducting your own due diligence before entering into any housing arrangement.

We strongly encourage users to:

  • Verify the identity of people they communicate with.
  • Verify property ownership or authorization.
  • Visit properties when appropriate.
  • Review leases and agreements carefully.
  • Never send money solely because a person has created a profile or listing.
  • Use appropriate caution when sharing personal or financial information.

8. No Guarantee of Users or Listings

GayRoomies.net does not guarantee that:

  • A user is who they claim to be.
  • A landlord actually owns or controls a property.
  • A property exists or is available.
  • A listing is accurate.
  • A rental price is accurate.
  • A user will honor an agreement.
  • A roommate or housing match will be successful.
  • A user will behave appropriately.
  • A transaction will be completed.

Users are responsible for evaluating and verifying other users and listings before entering into any arrangement.

9. Safety and Fraud Prevention

Housing scams can occur on online marketplaces.

You agree not to use GayRoomies.net to conduct fraud, scams, identity theft, money laundering, or other unlawful activity.

Examples of prohibited behavior include:

  • Fake rental listings.
  • Advertising property that you do not control.
  • Requesting deposits for nonexistent properties.
  • Impersonating landlords or tenants.
  • Using stolen identities or photographs.
  • Requesting payment through deceptive means.
  • Attempting to obtain another user’s financial information.
  • Creating multiple fraudulent accounts.
  • Providing intentionally false information.

If you encounter suspicious activity, scams, harassment, threats, or fraudulent listings, please report the activity to GayRoomies.net.

10. Prohibited Conduct

You agree not to use GayRoomies.net to:

  • Break any law or regulation.
  • Defraud or deceive another person.
  • Harass, threaten, stalk, or intimidate another user.
  • Discriminate unlawfully against another person.
  • Publish knowingly false information.
  • Impersonate another person.
  • Upload malicious software or harmful code.
  • Attempt to gain unauthorized access to accounts or systems.
  • Scrape or collect user information without authorization.
  • Spam users.
  • Send unsolicited commercial messages.
  • Promote illegal activities.
  • Promote fraudulent housing opportunities.
  • Post content that violates another person’s rights.
  • Circumvent membership restrictions or platform security.
  • Create accounts for the purpose of evading a suspension or ban.
  • Use the platform for purposes unrelated to its intended services.

11. LGBTQ+ Community Standards

GayRoomies.net was created to provide a welcoming housing community for LGBTQ+ people and supportive, gay-friendly housing providers.

Users are expected to treat other members with respect.

We do not permit harassment, threats, hateful conduct, or targeted abuse directed at individuals or groups.

At the same time, GayRoomies.net does not authorize users to violate applicable housing, employment, public-accommodation, or anti-discrimination laws.

Users are responsible for ensuring that their listings, screening practices, roommate requirements, advertising, and housing decisions comply with all applicable laws.

GayRoomies.net may remove content or restrict accounts that violate our community standards.

12. Fair Housing and Anti-Discrimination

Users are responsible for complying with all applicable federal, state, and local fair-housing and anti-discrimination laws.

GayRoomies.net does not encourage or authorize unlawful discrimination in housing.

Depending on the circumstances and applicable law, housing-related restrictions or preferences may be legally regulated. Users should obtain appropriate legal advice regarding their individual circumstances.

GayRoomies.net may remove listings or content that we reasonably believe violate applicable law or our policies.

13. User Content

Users may submit or upload content, including:

  • Text.
  • Photographs.
  • Profile information.
  • Listings.
  • Reviews or comments.
  • Messages.
  • Other materials.

You retain ownership of content that you submit, subject to the rights granted to GayRoomies.net under these Terms.

By submitting content to GayRoomies.net, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, and otherwise use that content as reasonably necessary to operate, maintain, promote, and improve the service.

You represent that you have the necessary rights to submit the content and that your content does not violate the rights of another person.

14. Photographs and Media

You may only upload photographs and other media that you have the right to use.

You may not upload:

  • Stolen photographs.
  • Photographs belonging to another person without permission.
  • Misleading property photographs.
  • Content that violates another person’s privacy.
  • Illegal or prohibited content.

GayRoomies.net may remove photographs or media that violate these Terms.

15. Messaging and Communications

GayRoomies.net may provide tools that allow users to communicate with one another.

You agree to use these tools responsibly.

You may not use messaging features to:

  • Harass another user.
  • Send spam.
  • Conduct fraud.
  • Request sensitive financial information.
  • Distribute malware.
  • Promote unlawful activities.
  • Circumvent platform restrictions.

Users should exercise caution when communicating with people they do not know.

GayRoomies.net may investigate reported communications where reasonably necessary to protect users, enforce these Terms, or comply with legal obligations.

16. Matching Services

GayRoomies.net may provide roommate or housing matching features based on information supplied by users.

Matching results are provided for informational and convenience purposes only.

A match does not constitute:

  • An endorsement.
  • A background check.
  • A guarantee of compatibility.
  • A guarantee of safety.
  • A recommendation to enter into a rental agreement.
  • A guarantee that a property or person is legitimate.

Users are responsible for independently evaluating potential matches.

17. Memberships and Paid Services

GayRoomies.net may offer free and paid membership plans.

Paid features may include enhanced visibility, additional listing capabilities, advanced search, matching features, communication tools, or other premium services.

The features, limitations, and pricing of each membership may be described on the applicable membership page.

By purchasing a paid membership, you authorize the applicable payment provider to charge the applicable fees.

Unless otherwise stated, fees are non-transferable and may not be exchanged for cash.

18. Subscriptions and Automatic Renewal

If a membership is offered as a recurring subscription, your subscription may automatically renew at the end of each billing period unless you cancel it before the renewal date.

The applicable renewal price will be presented during the subscription process or otherwise disclosed to you.

You are responsible for managing your subscription and cancellation settings.

Cancellation generally prevents future charges but does not necessarily result in a refund for the current billing period unless required by law or expressly provided by our refund policy.

19. Refunds

Refund eligibility depends on the applicable membership plan, purchase terms, and applicable law.

Unless otherwise stated, fees for subscription periods that have already begun are generally non-refundable.

GayRoomies.net may provide refunds or credits at its discretion where appropriate.

Nothing in this section limits any refund rights that cannot legally be waived.

20. Changes to Services

GayRoomies.net may add, modify, suspend, or discontinue features or services at any time.

We may change membership plans, pricing, features, limitations, or functionality.

Where required by applicable law, we will provide appropriate notice of material changes.

21. Account Suspension and Termination

We may suspend, restrict, or terminate an account if we believe a user:

  • Engaged in fraudulent activity.

  • Abused another user.
  • Attempted to manipulate the platform.

We may also remove individual listings, profiles, messages, photographs, or other content.

Where appropriate, we may take action without advance notice.

22. Intellectual Property

The GayRoomies.net website, branding, logos, design, software, text, graphics, features, and other original materials are owned by or licensed to GayRoomies.net and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit our proprietary materials without written permission.

The GayRoomies.net name, logos, and branding may not be used without authorization.

23. Third-Party Services

GayRoomies.net may integrate with third-party services, including payment processors, hosting providers, analytics providers, mapping services, communication services, or other technology providers.

Third-party services may have their own terms and privacy policies.

GayRoomies.net is not responsible for the operation, availability, security, or policies of third-party services.

24. Privacy

Your use of GayRoomies.net is also subject to our Privacy Policy.

The Privacy Policy explains how information may be collected, used, stored, and disclosed.

By using GayRoomies.net, you acknowledge that you have reviewed our Privacy Policy.

25. Disclaimer of Warranties

GayRoomies.net is provided on an “as is” and “as available” basis to the maximum extent permitted by law.

We do not guarantee that:

  • The website will always be available.
  • The service will be uninterrupted.
  • The website will be error-free.
  • Listings will be accurate.
  • Users will be trustworthy.
  • Housing opportunities will be legitimate.
  • Matches will be successful.
  • The platform will meet every user’s expectations.

You use the service at your own risk.

26. Limitation of Liability

To the maximum extent permitted by applicable law, GayRoomies.net and its owners, operators, employees, contractors, affiliates, and service providers will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the platform.

This includes losses resulting from interactions or transactions between users, including rental agreements, roommate arrangements, property transactions, deposits, payments, personal injury, property damage, fraud, or disputes.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

27. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless GayRoomies.net and its owners, operators, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your use of the platform.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your content.
  • Your interactions with other users.
  • Your rental, housing, roommate, or property transactions.

28. Disputes Between Users

GayRoomies.net is not responsible for resolving private disputes between users.

Users are encouraged to communicate directly and seek appropriate legal assistance when necessary.

If a dispute involves conduct that violates these Terms, GayRoomies.net may review the matter and take appropriate action on the platform.

29. Reporting Violations

If you believe that another user, listing, profile, message, or other content violates these Terms, you may report it through the reporting tools provided on the website or by contacting GayRoomies.net.

When reporting an issue, provide as much relevant information as possible.

We may investigate reports and take action at our discretion.

30. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we may update the “Last Updated” date at the beginning of this document.

Your continued use of GayRoomies.net after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

31. Governing Law

These Terms will be governed by the laws applicable to GayRoomies.net and the jurisdiction specified in our final legal configuration, without regard to conflict-of-law principles.

Any venue, jurisdiction, arbitration, or dispute-resolution provisions should be interpreted in accordance with applicable law.

32. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

33. Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement between you and GayRoomies.net regarding your use of the platform.
